Why firms fail audits — and why ours don’t have to

Spot audits are rarely failed on misappropriation. They are failed on mechanics: reconciliations done late or not at all, differences carried unexplained, client ledgers that no longer tie to the bank. Those are bookkeeping failures — which means they are preventable by bookkeeping. The full requirements are in our By-Law 9 reference; the division of labour is simpler still: we keep the records and reconcile, you review and sign.

Asked by firms

We just opened a trust account. What must exist from day one?

The By-Law 9 record set: trust journals, per-client ledgers, and a monthly three-way reconciliation completed within 25 days of month-end — plus a financial institution that provides the required source documents, like cheque images. Starting compliant is a setup task; becoming compliant later is a reconstruction. We do the setup as part of onboarding.

Our reconciliations are months behind. How bad is that?

It is the single most common spot-audit finding, and it is fixable the same way any backlog is: rebuild month by month, tie each three-way, document the differences. Better done before the Law Society letter than after — examiners read a self-corrected record very differently from an uncorrected one.

Can you move us onto LEAP Legal from PCLaw or spreadsheets?

Yes — matter migration, trust configuration to your province's rules, document templates and team training are exactly what our LEAP Legal certification covers. Balances tie out to the day you switch, and the trust history carries over intact.

Do you work with paralegal practices?

Yes — Ontario paralegals operate under the same By-Law 9 record-keeping regime, and the trust discipline is identical. Sole practitioners are welcome; trust compliance does not scale down its requirements for small practices, so small practices are precisely who needs it handled.
